Lessig down... why would Digg ban it?

Why is the basic response to this: "How could YouTube and Digg censor this!!!" I think this is a positive in a number of respects actually:
-Says a lot about the power of mash-ups. Shouldn't Lessig love that? Isn't his thesis that mashers fundamentally change content? Then just because Fox initially broadcast many of the images should not be part of the discussion around the ban. Also it's important to note that the voice-over and 'porn' in the title are significant from the standpoint of YouTube and Digg censors).
-This is also a positive in that it lets people know that yes, our beloved YouTube is a censor. In fact, that's pretty much the only service other than the domain that YouTube provides. I'm not saying it's not important or justified but this should be a wake-up call to people, just not in the way many are making it out to be: 'A Fox News/Youtube/Digg cabal.'

Social commentary aside, I still turn to E! for instant flesh gratification that only basic cable can provide.

Also, without having read the links, I would assume YouTube was DMCA'd which leaves them little choice in the matter.
